Court rejects Nirvana cover boy's suit

An American court dismissed the claim of a man who was photographed in infancy for the cover of Nirvana's album Nevermind (1991), Spin reports.

In December 2021, Nirvana's lawyers asked the court to dismiss the claim against the collective, pointing out that the statute of limitations had expired in the case of Spencer Elden's cover boy. They also called the plai.jpg's claims absurd.

The District Court in Central California allowed the lawsuit to be changed, dismissing it. The court's decision is due to the fact that the petition of the group's lawyers had to be challenged before December 30. A new lawsuit can be filed before January 13, and Elden's lawyers will not have another attempt. Representatives of Nirvana will need to respond to the new lawsuit by January 27.

On the eve of the 30th anniversary of the legendary release, Spencer Elden demanded that Universal Music edit the photo showing his genitals. His lawyer Maggie Maby pointed out that her client was photographed completely naked in the pool in 1991, which is a violation of confidentiality and child exploitation. Spencer has had a hard time with unwanted media and fan attention every year during Nevermind's anniversary year, she said.
