Now, according to the Labor Code, women on parental leave, on the basis of an application, have the right to work part-time or at home and at the same time receive childcare benefits. But in practice, as lawyers say and court practice testifies, everything is different. It is believed that if a woman works, then she has an income, respectively.

“Now, going to work, even on a shorter working day, almost always means the end of the payment of benefits. The courts accepted the point of view of the Social Insurance Fund and refused to work women in receiving childcare benefits. this should not lose the right to childcare benefits, "lawyer Olga Sulim explained to Rossiyskaya Gazeta.

The submitted bills propose to establish a fixed working day, which will allow receiving benefits: no more than 50% of the standard eight-hour working day, that is, four hours a day. Accordingly, if a woman works, for example, six hours a day, she will not be eligible for childcare benefits.

Thus, according to the authors of the bills, a balance of interests will be maintained: a woman will be able to compensate for the time during which she is caring for a child, and benefits from the Social Insurance Fund will not be paid to those who actually work a full day (5-7 hours each) ... However, these bills still have to go through the appropriate procedure for adoption and approval, and it is possible that certain adjustments will be made to their content.
