Russia - Debtors will be able to defend the fireproof residue

Russia (bbabo.net), - One-time social payments received the so-called executive immunity: no matter what a person's debts, not a penny cannot be taken from these payments.

In other cases, debtors will be able to write a statement to the bank so that, when collecting from their salaries, they leave a living wage on their account.

Vladimir Gruzdev, Chairman of the Board of the Russian Bar Association, recalled that it has become a practice to regularly appoint by the President of Russia and the government of the country one-time targeted social payments.

For example, during the pandemic, social benefits for children were also repeatedly assigned. There were one-time payments to retirees.

“And these are far from all the support measures that were provided to citizens during the difficult period of the pandemic,” emphasizes Vladimir Gruzdev. “There is confidence that the practice of targeted social payments will continue. And it is extremely important that any payments with a social focus will be protected by law. In the future, it will not be necessary to amend the law every time when deciding on one or another one-time social payment. "

He recalled that the law prohibits the imposition of penalties in enforcement proceedings on certain payments. For example, immunity extends to alimony, survivor pensions, maternity capital funds, etc.

Now this list also includes lump-sum social payments appointed by the president or government of the country. How much a person is assigned, so much he should get his hands on.

In some cases, claimants bring the writ of execution directly to the bank, where the debtor has a payroll account. But now a person will be able to establish an inviolable minimum pay

Another innovation: debtors will have the right to write a statement to their bank with the requirement to leave a living wage when collecting certain monthly payments from their salaries. The law protecting the living wage was passed last year. The norms come into force in February this year. But they stipulate the right of the debtor to apply to the bailiff service with a corresponding statement. As told in the department, it will be possible to submit an application through the portal of state services.

The law, which is being published today, enables a person to fix the minimum balance with the help of an application to the bank.

In some cases, claimants bring the writ of execution directly to banks, bypassing the bailiffs. So the new norms increase the social protection of the debtor.
