Spain denied asylum to thousands of Ukrainians who do not want to fight in Donbass

Thousands of Ukrainians who do not want to fight in the ranks of the Ukrainian army in Donbass are trying to get asylum in other countries. According to El Mundo, citing data from the Spanish Commission for Refugee Assistance, the Iberian kingdom alone received about 3,000 such applications in 2020. But almost always the Ministry of Internal Affairs and the National Court of Justice (when trying to challenge the decision of the Ministry of Internal Affairs) refused them. Asylum was granted to only 232 Ukrainians, that is, in less than 10 percent of cases.

However, the reasons why Ukrainians are asking for asylum are indicative here. For example, in one of the latest appeals considered by the National Court of Justice, a 39-year-old citizen of Ukraine stated about the risk to life that would inevitably arise if he was drafted into the army. His friends, called earlier, have already died in the intra-Ukrainian conflict, and he does not want to repeat their fate. The man has already received three subpoenas and is now hiding with his girlfriend.

Both the Ministry of Internal Affairs and the court refused him, considering that the conscription of reservists in Ukraine is not a basis for granting asylum. The refusal order also notes that the court was not provided with evidence that desertion or refusal to join the Ukrainian army "is accompanied by degrading or inhuman treatment" in relation to the conscript.

At the end of last year, a nurse was also refused, who fears that she will be drafted into the army because of her professional skills (in Ukraine, all women aged 18 to 60 years old were obliged to report to military enlistment offices for registration during 2022, refusal threatens fine).

Nor could they receive asylum in Spain for two sisters who live near Donbass, where the intra-Ukrainian conflict has been going on for almost eight years. Their life has become unbearable due to the military base built next to their house, constant checks of documents and ongoing exercises (women are afraid that a shell could fly into their house, this has already happened in Ukraine). In addition, their relative was subjected to violence by a Ukrainian soldier, but they were afraid to turn to law enforcement agencies, since in the current conditions the police have no power, their statement says.

However, the Spanish side also refused them, considering that the conflict in Donbass was limited to a number of regions, and the applicants lived quite far from them.
