Will the employer pay for the absence from work without sick leave?

The Ministry of Labor and Social Protection of Belarus said that employers were given the right to release an employee from work due to his illness for up to three calendar days without providing sick leave or other documents confirming the illness. This norm is enshrined in paragraph 14 of the Presidential Decree of April 24, 2020 N 143 "On Supporting the Economy".

"If an employee feels unwell, he can apply to his immediate supervisor with a request to be released from work due to poor health. The employee agrees on a period of release from work, which can be one, two or three days," the Ministry of Labor and Social Protection specified. Exemption from work without providing a supporting document cannot exceed three days in total during the period of the decree.

The procedure for interaction between the employee and the employer for the implementation of this norm can be fixed in the local legal act of the organization. The preservation of average earnings for the period of release from work may be provided for by a collective agreement, other local legal act of the organization, with the exception of budgetary organizations and other organizations receiving subsidies, whose employees are equated in wages with employees of budgetary organizations.
