In other regions, in the first four months, residents legalized 10,000 garages and plots under them. Not so much. Correspondents checked how the garage amnesty is going on in the regions. They don't pay for land

Residents of Tatarstan and Mordovia were the most willing to use the possibility of registering garages. Omsk region is also among the leaders.

One of the first to take advantage of the garage amnesty in Tatarstan was 72-year-old Pavel Arbeev. He built the garage back in 1972 and registered it in 2018. But with the plot it turned out to be more difficult. After all, earlier it was possible to register it as a property after the redemption of the land, and at the cadastral value. And this is a lot of money.

The garage amnesty helped Pavel Grigorievich not only save the family budget, but also become the owner of the site without red tape. And there are enough such examples in Tatarstan. 237 land 55 garages have already been registered in a simplified manner. "Judging by the number of incoming documents, interest in the garage amnesty is only growing," Azat Zyabbarov, head of the Rosreestr Department for Tatarstan, admits.

Quickly and without hassle

At first, when the federal law had just come into force, many were at a loss. They did not know how to get this service, what documents are needed. It was not clear what types of garages are eligible for the amnesty and whether it is possible to issue boxes in multi-level garage complexes under it.

Now, they say in the Department of Rosreestr for Tatarstan, this is no longer the case. It was also possible to avoid misunderstandings on the part of local governments, the efficiency of which largely determines how quickly a person can become the owner of a garage and a plot under it. "We discussed this with representatives of the authorities long before the start of the amnesty," explains Azat Zyabbarov. "And now, according to the documents that the municipal authorities send us electronically, decisions are made instantly."

How quickly and without hassle to arrange a garage or a plot under it, the experience of Mordovia, which is also among the leaders, shows. According to the regional department of Rosreestr, 225 land 16 garages were registered under the new simplified procedure. The amnesty applies to garages built before December 30, 2004 - that is, before the entry into force of the Town Planning Code of the Russian Federation. The land on which the garage is located must be state or municipal. The algorithm has already been worked out in the republic: first, the owner submits an application to the local administration, any document confirming the fact of owning a garage must be attached to it. This may be a previously received decision on the distribution of the garage, technical inventory documents, an agreement on connecting the facility to engineering networks.

The vicious circle has been broken

It is important that the registration procedure will not require large expenses. But if the building was not on the cadastral register, a technical plan will be required. To compile it, you will have to contact a cadastral engineer. "The first stage is the cadastral registration of the land plot," the department of Rosreestr for Mordovia clarified. "The next stage is the state registration of ownership of the land the garage."

As motorists admit, the new mechanism greatly simplifies the registration procedure. “Earlier, a garage could not be registered if the owner did not have documents for the land. And vice versa, you can register a plot if the property located on it is legal. It turned out to be a vicious circle. Now there is no such problem,” said the chairman of the Saransk garage cooperative Talisman Vitaly Mikaev.

Designed - and sold

Active garage amnesty also enjoy residents of the Omsk region. In the region, 961 objects had their name changed in the Unified State Register of Real Estate from a building to a garage. Another 10 garages were "amnestied" and registered for the first time. Omsk residents were spurred to the paperwork by the mayor's office's fight against illegal buildings. Since the beginning of 2021, three hundred illegally located garages have been demolished on the territory of Omsk. At the same time, the townspeople not only lost their place for a car, but also did not receive any compensation. The owners of the dismantled objects, on the contrary, were issued impressive bills for the demolition and towing services.

The fear of losing property forced many motorists to put the garage on state cadastral registration. Omsk residents also realized that after the design of the building, it can be profitably sold. True, in order to legalize a garage, you will have to pay about 10 thousand rubles for the services of a cadastral engineer. But on the other hand, a capital brick garage on the market is estimated at 250-300 thousand rubles.

Rejectionists

Dagestan and Sakhalin are among those regions where no one has yet issued a garage under an amnesty. Why? After all, there are enough people on Sakhalin who want to take advantage of the federal law. People come and call the administration of Yuzhno-Sakhalinsk every day. But in no time become the owner of the site does not work. “Rejections occur because land surveying projects have been developed on the territories where garage-building cooperatives are located. And in order to form a land plot under a garage box, it is necessary to make an adjustment to the existing project or create a new one,” explains the deputy director of the department of land use of the city of Yuzhno-Sakhalinsk Natalia Fuflygina. But it turned out to be not so easy. Land surveying projects simply do not take this possibility into account.

Now the residents of South Sakhalin have to write applications to the Department of Architecture and Urban Planning. And ask them to take into account their desire to issue a land plot when adjusting or developing a new survey project. Dagestan has a completely different story: the regional department of Rosreestr explained that any document issued before 2005 can confirm the ownership of a garage. But there are subtleties.

As explained in the Federal Register of the Republic, with this document you must contact the administration of the municipality on whose territory the garage is located. There, a resolution is issued on the preliminary approval of a land plot for granting it to the property. Next, a cadastral plan is being prepared, and with this package, Rosreestr registers the right of ownership. And after registration, the owner again applies to the administration of the municipality and receives a decision to provide a site for a garage amnesty.

The absence of many documents for garages and the complicated, in the opinion of car owners, bureaucratic procedure for re-registration of ownership became the reason that Dagestanis did not take advantage of the garage amnesty. This is especially true of Makhachkala, where garages were actually received without paperwork.

After 2013, when the long-term mayor Said Amirov received a life sentence, the mayors were replaced regularly, some were also convicted. The new leadership of the city, wanting to return the seized, in their opinion, plots to municipal ownership, began to annul the decisions of previous mayors through the courts. "In such a mess, people have ceased to trust the documents issued by local authorities. And therefore, they are waiting for now," lawyer Abdul Magomedov explained.
