The court rejected the claim of Tinkoff Bank to Beeline for 437 million rubles

On January 28, 2022, the Moscow Arbitration Court rejected the claim of Tinkoff Bank against Beeline for 437 million rubles. The status of the bank's statement of claim in the file of arbitration cases is now indicated as "the claim is completely dismissed." The third party in the litigation between Tinkoff Bank and Beeline was the Federal Antimonopoly Service (FAS).

According to the text of the statement of claim, Tinkoff Bank accused Beeline of abusing its dominant position by setting and maintaining a monopoly high price for SMS mailing services, as well as creating discriminatory conditions. Beeline's lawyers did not agree with the bank's claims and were able to defend their position in court. In connection with this claim, the plai.jpg and third parties filed several petitions for the addition of additional documents to the case file. The court also heard explanations from representatives of VimpelCom (the owner of the Beeline brand) and the Federal Antimonopoly Service. Moreover, in this case, Beeline's lawyers filed a petition for falsification of evidence, and then the plai.jpg submitted written objections and an expert opinion.

Of the three Russian telecom operators against which Tinkoff Bank filed such claims, the court ultimately dismissed all three claims.

On March 29, 2021, Tinkoff Bank filed a lawsuit against MTS for 1.1 billion rubles. A representative of Tinkoff Bank specified that MTS “did not comply with the FAS order to stop violations of antimonopoly laws for a long time,” and at some tariffs for SMS mailings, the cost of the operator’s services even increased. MTS explained that it does not agree with the claims of the bank and intends to defend its position.

On May 31, Tinkoff Bank filed a lawsuit against Vimpelcom (Beeline brand) for 436.8 million rubles.

On June 15, Tinkoff Bank filed a lawsuit against Megafon for 677 million rubles with the Moscow Arbitration Court.

On October 20, a Moscow court rejected the claim of Tinkoff Bank against MTS for 1.1 billion rubles.

On December 16, 2021, the court rejected the claim of Tinkoff Bank against MegaFon for 677 million rubles.

In May 2019, the FAS acknowledged that mobile operators MTS, T2 Mobile (Tele2) and Vimpelcom violated the law on protection of competition. In fact, the cost of their services for organizations was 10 times higher than the cost of similar services for organizations with state participation in capital. This created discriminatory conditions and was contrary to antitrust laws. In addition, the FAS determined that the operators set monopoly high prices for the SMS mailing service. The department issued instructions to telecom operators, in connection with which they had to reduce tariffs.
