Millionaire Oleg Boyko won a lawsuit against Google - the company is obliged to remove from the search links to inaccurate materials about him

The Gagarinsky Court of Moscow satisfied a repeated claim by Oleg Boyko, the head of the international diversified investment group Finstar, among the most significant assets of which is the Rive Gauche chain of stores. The billionaire filed a lawsuit against Google demanding to remove links to sites from the search results, which, according to him, contain false information about him. During the proceedings, the court found that 11 provided fragments contained facts “untrue and discrediting” Boyko's reputation. In accordance with the federal law "On information, information technology and information protection" the company is obliged to stop issuing information of such a plan.

As the millionaire's lawyer noted, all attempts to settle the dispute before the trial were unsuccessful. The proceedings on this issue began back in 2019, when “at least one anonymized site”, registered outside the Russian Federation, appeared on the Web. According to the lawyer, it contains "strange and often delusional", inaccurate information. For example, that Oleg Boyko is personally to blame for the crisis in the Asian markets in 1997.

RBC did not provide specific information on what materials were required to be blocked in the extradition. But, probably, we are talking about a repeated lawsuit filed by a businessman after the previous one was rejected. The first claim was also considered by the Gagarinsky Court of Moscow. Boyko demanded that Google stop issuing links with information about his possible connection with the Solntsevo organized criminal group. Then the court concluded the following:

“The court concludes that the defendant is not the author of the information about the plai.jpg, and he also did not take any action to post this information on the controversial Internet sites, which is not disputed by the plai.jpg's side at the hearing. The court agrees with the defendant's argument that the Google search service located on the website www.google.ru does not distribute information and cannot be held responsible for information posted on the Internet by third parties. "

In addition, as noted by the court, Boyko did not provide enough facts to prove that Google gives out all the links indicated by the millionaire to Internet resources with "unreliable" materials. The Moscow City Court recognized the decision of the Gagarin court as legal. It is not known what changed when the claim was resubmitted and why the court satisfied it.

In 2019, the Central Bank issued two instructions to Oleg Boyko on the existence of facts of unsatisfactory business reputation in accordance with 151-FZ "On Microfinance Activities and Microfinance Organizations." According to it, a person included in the "black list", directly or indirectly, to dispose of more than 10% of the shares of companies. A few weeks later, Boyko's representatives called the bank's decision a mistake, and then the Central Bank itself confirmed the "good faith of the actions" of the millionaire.
