Google lost to TV channel Tsargrad in the court of appeal

Google has lost in the Ninth Arbitration Court of Appeal "Tsargrad", it follows from the information in the file of cases. The court overturned the decision of the previous court on the claim of the TV channel against the American tech giant and ruled to adopt a new judicial act on the case.

Recall that Tsargrad is arguing with Google over the blocking of a YouTube channel in July 2020. In April 2021, the Moscow Arbitration Court ordered to restore the channel's page and pay a forfeit. The company later appealed this decision.

The Court of Appeal confirmed the findings of the Arbitration Court and found Google's actions unlawful, Forbes reports with reference to Constantinople itself. In addition, the fine in the amount of 100 thousand rubles per day remained in force, which will increase in a progressive manner every week.

Art de Lex Managing Partner Dmitry Magonya, representing the interests of Tsargrad, noted that according to the new court decision in the first nine months, the maximum amount of the penalty cannot exceed 1 billion rubles - there was no such restriction before.

Tsargrad calculated that if Google refuses to restore the channel's YouTube page, then by March next year the penalty will be 1 billion rubles. If YouTube does not comply with the court's decision by this deadline, then there will be no limit on the fine, says Magonya.

The owner of the TV channel, Konstantin Malofeev, said that by this court decision, Russia "defended its digital sovereignty." Google has the right to appeal the decision of the court of appeal in cassation, but this does not cancel the entry into force of the court decision, Malofeev argues.

Google declined to comment on the new appellate ruling.

The reason for blocking "Constantinople" on YouTube was the US sanctions. At that time, the channel had 1 million subscribers. Google argued that the court's decision provides for a fine that is disproportionate to the case at hand. If a limit of 1 billion rubles had not been imposed on its size, then seven months after the blocking, the amount would have increased to 94 trillion rubles, which is equal to the capitalization of Alphabet.
