The court fined GitHub 1 million rubles for failure to remove prohibited content

On December 23, 2021, the Magistrates' Court of the Tagansky District of Moscow fined GitHub 1 million rubles under the Roskomnadzor protocol for not removing content prohibited in the Russian Federation.

An administrative penalty on GitHub in case # 05-3176 / 422/2021 was imposed by the court for the service committing an offense under paragraph 2 of Art. 13.41 of the Administrative Code of the Russian Federation. The fine for each administrative case based on the ILV protocol in this case can be from 800 thousand to 4 million rubles. In the event of a repeated violation, the service may receive a fine under paragraph 4 of Art. 13.41 of the Administrative Code of the Russian Federation, which is already more serious - from 3 to 8 million rubles.

By law, GitHub has 60 days to pay the fine from the moment the court's decision on it comes into force.

On December 1, 2021, the Tagansky District Court of Moscow received a protocol from Roskomnadzor on GitHub for the platform's failure to delete prohibited content. This is the regulator's first protocol against a web service hosting IT projects for such a violation.

On December 3, the media reported that the protocol, which went to court on GitHub for not removing prohibited content, was issued by the regulator due to the administration's refusal to remove from the platform the repository with Smart Voting data, which is included in the register of information prohibited in Russia. Technically, Roskomnadzor may still issue protocols on this violation to the court against GitHub, since the service has not yet complied with its requirements for this situation. Most likely, this will be the case - GitHub will receive more new penalties.

On November 1, 2021, Roskomnadzor reported on its Telegram channel that since the beginning of the year, the department has issued protocols to Russian and foreign social networks and services, according to which the court imposed fines in the amount of more than 190 million rubles for failure to delete prohibited information. At the moment, four foreign IT companies have already paid the fines - TikTok, Google, Facebook and now Telegram. Other companies have started an appeal process against them, but the Russian court has already denied them several times in their complaints.
