Russia (bbabo.net), - The Supreme Court reaffirmed its previous position: it is pointless for citizens who are punished for not wearing masks in places where wearing them is mandatory to challenge the fines.

The fact is that some punished buyers argued that outlets should have provided masks to visitors, but they did not. But the SC stated that this does not absolve citizens from responsibility. The Pravo ru portal told about this decision of the Supreme Court.

If the store did not provide the visitor with personal protective equipment, this does not give the person the right to be there without a mask. That is exactly what was said in the end of the Supreme Court's consideration of two similar cases in January.

The person involved in one of these cases was in the building of the Central Market of Kurgan without a mask, although this was required by the sanitary rules and restrictions imposed in the region. As a result, the person was punished.

In the Kurgan City Court, the violator did not argue with the fact that he was in the building without a mask, but stated that he considered the mask regime illegal. The court found him guilty and fined him 2,000 rubles. Higher authorities confirmed the correctness of the punishment.

But the fined complained to the Supreme Court. In his opinion, the administration of the outlet is obliged to provide the visitor with personal protective equipment. Shops and other public places themselves must offer masks to people "according to government health regulations."

The second complainant walked into a shopping center in Abakan last January without a mask. In Khakassia, a mask regime for public places has been and is still in effect.

The result - the Abakan city court saw this as a violation of sanitary rules and fined the buyer for 7,500 rubles. A fined resident of Abakan also went to the Supreme Court, where he referred to the fact that he was not offered a mask in the shopping center.

In the second case, the Supreme Court also emphasized the lack of evidence that there was no stock of masks in the designated area of ​​the mall.

The Supreme Court in rulings on these cases confirmed the violations of the citizens themselves. And they are not related to whether the stores have fulfilled their obligation to provide masks to visitors.

The qualification of actions does not depend on the inaction of other persons, and the obligation to observe the mask regime is assigned directly to citizens, the Supreme Court of the Russian Federation pointed out.

In the first review of practice in "coronavirus" cases, the Presidium of the Supreme Court explained that the law "On the protection of the population and territories from natural and man-made emergencies" requires compliance not only with the norms specified in it, but also with additional requirements that may be introduced by regional authorities.

Therefore, the High Court emphasized, bringing to administrative responsibility for violating local sanitary rules is quite legitimate.
