Sports lawyer Valery Fedoreev commented on the decision of the Court of Arbitration for Sport (CAS) to allow figure skater Kamila Valieva to further participate in the 2022 Olympic Games in Beijing.

He emphasized that this decision only confirms the lifting of the athlete's provisional suspension after a positive result of her doping test. However, after the Games, the lawyer noted, there will be a consideration of the case on the merits, and the final verdict may not be in favor of Camila.

“In this situation, this is the Solomonic solution, the most logical. But it is only intermediate. Since the analysis of the sample took longer than usual, and she was not notified in a timely manner, this violated Valieva's right to legal protection before the Olympics.

But this decision by CAS means that she has only canceled the provisional suspension from participation in competitions, which is mandatory if a prohibited substance is found in the sample. Yes, she was allowed to participate in the Olympics. But after its completion, consideration of Valieva's case will begin on the merits. Therefore, to our great regret, the point has not been made in Valieva's case.

Does this mean that under unfavorable circumstances, Valieva can still be found guilty of an anti-doping rule violation, and her results at the 2022 Games cancelled? I do not exclude. But this will be the subject of further investigation. They can cancel both a personal medal and a team medal, but not necessarily, ”said Fedoreev.

Kamila Valieva, as part of the Russian national team, became the champion of the 2022 Games in the team championship, but the award ceremony was postponed due to the fact that traces of trimetazidine in a microdose were found in her doping test taken in December.

Valieva was given a temporary suspension, which she challenged with the Russian Anti-Doping Agency (RUSADA), and the restrictions were lifted. The International Olympic Committee (IOC), the World Anti-Doping Agency (WADA) and the International Skating Union (ISU) filed an appeal with CAS, but it was rejected.
