What tricks do car dealers use to extort money from customers?

Buying a new car from a dealership requires the consumer to carefully study the papers the dealer gives to sign and be familiar with typical tricks. About what to pay attention to and how not to succumb to manipulation - in the material Difficulties with the supply of new cars continue - in the face of a shortage of cars and a continuous rise in prices, it is easier to persuade a client to a deal that is unprofitable for him than with an excess of goods on market. However, it should be remembered that according to the current legislation, a person has the right to refuse to buy a car on credit if he does not need it, as well as to refuse to purchase insurance products or unnecessary options. This is recognized by the car dealers themselves.

Back to news Association "Russian Automobile Dealers" (ROAD). You can check the current lists of dealers that have agreements with automakers on the official websites of the auto companies themselves.

“Manufacturers and dealers now still have more kits with additional equipment. But this does not mean that the buyer can be forced to purchase, this is contrary to the law, including the imposition of any services.

The ROAD Association insists on maintaining customer focus and maintaining the reputation of the dealer community, but, unfortunately, we receive complaints from some buyers,” the association said.

Don't rush

The choice and purchase of a car - a technically complex and expensive product - requires a thorough approach. If the seller hurries the buyer with the choice of options, additional services and the signing of documents, it makes sense to be wary. Before signing legally binding documents and even more so paying a fee, you should carefully read and understand all the terms of a future transaction, without relying on the words of the seller. For the purchase of a particular car, it is best to request a quotation with detailed indication of its data and all installed options, and before making a decision, you should call and visit several car dealerships to find the best option.

On the phone, car dealership managers often say that the required car is available, but it is the only one in stock, and they suggest that you hurry up with the purchase - such statements should be taken critically.

Even with the continued shortage of new vehicles, the supply and availability of vehicles varies by vehicle brand and region.

It is possible to sue for the imposed “special stages”

In conditions of shortage, it is difficult to purchase a car in stock without additional equipment installed by the dealer, but you can compete with the seller because of the imposition of services. Conditioning the purchase of one product or service on the purchase of another service (or product) to the seller is prohibited by the law “On Protection of Consumer Rights”. If the imposition of services has taken place, you can file a complaint with Rospotrebnadzor and file a lawsuit against the seller.

In particular, in February, a resident of Krasnoyarsk managed to sue about 400 thousand rubles from a local car dealer for additional services imposed when buying a car.

According to the regional department of Rospotrebnadzor, when buying a car, the consumer was offered an ultimatum of legal support, roadside assistance and the possibility of evacuation.

It is not necessary to buy on credit

The opportunity for the buyer to pay for the goods in installments is provided for by Art. 488 of the Civil Code of the Russian Federation - and this is the right of the client, and not his obligation. At the same time, the Consumer Rights Protection Law provides that the seller is obliged to ensure that the buyer can pay for the goods with payment instruments or in cash.

A car dealer is interested in selling a car with the greatest benefit for himself: from a loan issued at a car dealership, CASCO insurance and other additional services, he often receives a much larger percentage than from the sale of the car itself.

And at the insistence of the seller, the loan agreement sometimes includes by-products that are not related to buying a car - opening bank accounts with the issuance of credit cards, life insurance services for the borrower or other risks.

Even if during the process of applying for a loan you agreed to additional voluntary insurance, you can refuse them at your own request and return the money paid.

The reason for the refusal should indicate that the service was imposed. The “cooling period”, during which it is possible to cancel the voluntary insurance contract with a full refund of the paid insurance premium, is 14 days - this norm is established by the Central Bank’s directive No. 4500-U dated August 21, 2017.The cost of additional insurance and financial products should be clarified separately if the manager tries to keep silent about them or assures that they are free. Even if the deal goes well in the end, it’s best to start preparing for filing a claim or potential litigation while still on the shore.

And before agreeing to the proposed loan terms from the partner banks of the car dealership, it is useful to consider alternatives. So, many banks offer their regular customers - for example, payroll, more favorable terms for lending, including for the purchase of cars.
