Russia began to compensate for restrictions on land use

In Russia, compensation has been introduced for restrictions on land use associated with a change in the designated purpose of plots. The corresponding law came into force on January 10.

The document says that losses will be reimbursed in the event of a change in the designated purpose of the land plot without the consent of the copyright holder. For example, it can be the creation or expansion of a specially protected natural area or when changing the boundaries of a settlement. Compensation can be issued on the basis of a petition from the local government.

“Compensation to owners when their rights to land plots are limited will be paid from the budget. The amount of damage is determined taking into account the market value of the property on the day preceding the decision to restrict the owner's rights, ”Andrey Eremin, a lawyer at Amulex.ru, told RBC.

According to him, the total amount of compensation will be calculated from the difference between the cost of the land plot on the market without restrictions and the same cost with restrictions.

In early December, it became known that the courts began to confiscate land from citizens that they do not use for their intended purpose. Lawyers note that the number of such cases in judicial practice is growing, including due to the strengthening of control over the use of land by Rosreestr.
