"It is important to clearly indicate that if there are two or more signs of an employment relationship between an employee and an employer, the contract must be an employment contract," he said. The deputy recalled that today the Labor Code already has an article that prohibits replacing an employment contract with a civil law one. However, this rule requires clarification. Today, unscrupulous employers often try to get away from labor relations, because then they do not need to pay employees for vacation, sick leave, or provide other guarantees, for example, mandatory payments in case of reduction, Isaev says.

Earlier, the Ministry of Labor proposed expanding the number of insured citizens in the insurance system from 2023. It is assumed that employers will also have to pay contributions for compulsory social insurance in case of temporary disability for those employees who are registered under a civil law contract. Then social guarantees will apply to them too. In total, according to the Ministry of Labor, more than 4 million citizens work under civil law contracts today.
