The draft law on the legalization of guest houses may be submitted by the government to the State Duma in the near future, Sangadzhi Tarbaev, chairman of the State Duma Committee on Tourism Infrastructure Development, said in the office. The new rules will have to come into force on September 1, 2022.

Changes are expected to be made to the Federal Law "On the Fundamentals of Tourism in the Russian Federation". The bill was developed by Rostourism. In accordance with it, the owners of individual residential buildings will be able to legally accommodate guests and provide them with related services.

Only on the territory of the Crimea, Krasnodar, Altai Territories, according to the estimates of the Federal Tourism Agency, there are more than 15 thousand such objects. Now the status of guest houses is not regulated in any way, legal conflicts arise. By law, collective accommodation facilities in the country must be classified, they must be assigned a category. But it is impossible to recognize a guest house as a hotel, since a hotel cannot be located on land allocated for housing construction. Contradictions also arise in terms of connecting communications, sanitary control and fire supervision, says Yury Barzykin, vice president of the Russian Union of Tourism Industry.

As a result, guest houses operate illegally. Rooms are rented out without any permission. Owners of guest houses do not pay taxes, the committee points out.

The solution of the problem of guest houses has been approached for more than a year. It was discussed during Prime Minister Mikhail Mishustin's working trip to Altai in March 2021. Rostourism, the Ministry of Economic Development, the Ministry of Finance and Rospotrebnadzor were instructed to prepare their proposals for the withdrawal of guest houses from the shadows by July 1.

According to the head of Rostourism, Zarina Doguzova, the concept of a guest house, a description of its services and provisions on classification are supposed to be included in the law on the basics of tourism activities. It was also proposed to make the classification of guest houses mandatory and include these accommodation facilities in the Unified Federal Register. Initially, it was assumed that the law would come into force as early as January 1, 2022.

The developed bill introduces a notification procedure for the operation of guest houses. They will have to pass the classification voluntarily.
