Russia - Expert Nogailiyeva explains how pensioners can write off their debts

Russia (bbabo.net), - Retirees have several ways to legally get rid of their debts. This was told by the assistant of the Department of Labor and Social Law of St. Petersburg State University Fatima Nogailiyeva, the Prime agency reports.

According to the expert, the pensioner's debt can be written off during the lawsuit to recover it - if the debt arose more than three years ago. To do this, you need to declare that the plaintiff-claimant has missed the statute of limitations.

"Article 207 of the Civil Code of the Russian Federation limits the period of possible debt collection to three years, with the exception of certain obligations to which the limitation period does not apply or its period is reduced," the expert points out.

After a court decision on debt collection, the pensioner also has the opportunity to reduce the debt or get rid of it altogether. Thus, according to Nogailiyeva, the survivor's pension, paid from the federal budget, and additional payments to it from regional budgets, are protected from debt collection.

Also, a pensioner can submit a request to the bailiff service to maintain a pension in the amount of the subsistence minimum for the able-bodied population as a whole in Russia or at their place of residence, if its value exceeds the national one. The bailiffs will no longer be able to recover this amount, the expert notes.

Finally, any pensioner can also become bankrupt. The conditions for the bankruptcy of a pensioner are: the presence of a debt of more than 500,000 rubles, the inability to pay it due to low income and more than 3 months of delay. If the amount of debts does not exceed 500,000 rubles, then bankruptcy can be carried out out of court - by submitting an application to the center for the provision of state and municipal services.
