Vladimir Gruzdev, Chairman of the Board of the Russian Lawyers' Association, noted that every year interrogators of the Federal Bailiff Service make several thousand decisions to refuse to initiate a criminal case for malicious non-payment of alimony, and the reasons are often irregular and insignificant payments.

According to him, the adopted amendments to the Criminal Code and the Criminal Procedure Code will not allow citizens to avoid responsibility for non-payment of alimony for formal reasons: in the event that they pay some meager amounts. “Let me remind you that today there is a two-stage system of bringing to responsibility for non-payment of alimony. At one time, the plenum of the Supreme Court of Russia made explanations allowing for prosecution for non-payment of alimony in case of incomplete payments. However, as experts say, in practice, problems still arose with the prosecution of alimony workers who did not pay enough. The Chairman of the Board of the AYR emphasizes that the adoption of the amendments will completely close the loophole for unscrupulous alimony debtors.

One of the laws supplements Article 5.35.1 of the Administrative Code with a clarification, according to which failure to pay funds for the maintenance of children or disabled parents without good reason within two months "in the amount established in accordance with a court decision or a notarized agreement" will result in punishment. As TASS reminds, a defaulter, according to the current version of the Administrative Code, may face correctional labor for up to 150 hours, arrest for 10 to 15 days, or a fine of 20 thousand rubles.

The second law amends Article 157 of the Criminal Code. According to the amendments, failure to pay the full amount of funds for the maintenance of children or disabled parents will entail the prescribed punishment. In this case, the defaulter will be released from liability in case of full repayment of the debt.
