Initially, the insurance company refused to pay compensation to the victim, since the accident did not occur during the trip to work. After that, the employee decided to file a claim against the insurance company in court.

In its decision, the court clarified that German insurance law applies to remote workplaces to the same extent as in the case when an employee operates in a company office. If he walked there from the kitchen, then this was already a different situation for the insurance company - then she would have refused to pay, since this was already his second trip to work for the day and already from the kitchen. During the investigation, it turned out that he does not eat breakfast at all before work.

As a result, the court ordered the insurance company to pay compensation to a telecommuting employee for this incident with a work-related injury at work at home.
