Meta's defense asked the Russian court to stop the proceedings to ban the company's activities, the court rejected the request

On March 21, 2022, at a court hearing, the defense side asked to stop or postpone the proceedings to ban the company’s activities, as well as to appoint a linguistic examination on the claim demanding that Meta be recognized as an extremist organization. Lawyers of the company need more time to get acquainted with the case. For several days they did not have time to do it. By law, lawyers must have 15 days to familiarize themselves with the case materials and prepare for the process.

“Meta was not given sufficient time to prepare its position and gather evidence. According to the law, Meta should have received 15 days to familiarize themselves with the case materials and prepare a position, and in the few days that have passed since the case was received by the court, Meta could not familiarize itself with more than 500 pages of this case, ”said the company’s lawyer in a court.

Meta asked the court to appoint a linguistic examination of those statements that served as the basis for the appeal of the Prosecutor General's Office and accusing Meta of extremism.

Also, Meta's lawyers believe that the Russian court is not entitled to consider this claim, since it should be considered at the place of registration of the company - in the United States.

“We file a motion to terminate the proceedings, we believe that in this case the court does not have jurisdiction to consider this case, since Meta is a foreign law firm,” Meta’s defense said in court.

The representative of the state prosecution protested at the trial against all statements of the defense of Meta.

“Meta's lawyer had enough time to prepare for the start of the case. Our application has been sent to the Tverskoy Court in accordance with the procedural norms,” the prosecution explained.

“Taking into account the public danger of the information that Meta distributes, we consider it necessary to consider it as soon as possible,” the representative of the Prosecutor General’s Office of the Russian Federation outlined the plaintiff’s position.

As a result, today the court refused to terminate the proceedings on the suit to ban Meta in Russia. Also, the court did not give Meta more time to prepare for the consideration of the claim on the merits and refused to grant the defense's motion to terminate the proceedings.

On March 11, the Prosecutor General's Office filed a lawsuit demanding the recognition of Meta Platforms Inc. extremist organization and the prohibition of its activities on the territory of the Russian Federation. The actions of the department are caused by a change in the Meta moderation policy in some countries.
