Sports lawyer explains how Valieva can win her CAS case

Sports lawyer Valery Fedoreev, in an interview with a correspondent, explained how Russian figure skater Kamila Valieva can win a case in the Court of Arbitration for Sport (CAS).

“The CAS exit panel is working at the Olympics - accordingly, they will have time to consider the case. They work at the Games precisely for the prompt resolution of possible issues. If an Athlete is found to have a Prohibited Substance in his body, a mandatory Provisional Suspension will apply until the case is resolved. The athlete then has two options: either challenge the provisional suspension or insist on an expedited hearing. Provisional suspension is considered in the national arbitration body. Since Valieva disputed this, now the IOC and WADA - both of these bodies - can challenge the decision of our national sports arbitration in CAS. And this will be done by the exit panel.

The only more or less normal option for Valieva is to prove that the prohibited substance entered her body with a contaminated substance. For example, she took a medicine in which trimetazidine was present in microscopic doses. It looks very much like it was. And this is a very good basis for defense - but, of course, this will need to be proven, ”Fedoreev said.

Fedoreev also spoke about the fact that Valieva had not received any official information about doping for a long time.

“In practice, this happens because RUSADA sends samples to the WADA-accredited Stockholm laboratory. Consider: until they sent it, until the New Year holidays, Christmas passed ... Then there was the coronavirus. Of course, if everything was done in Moscow, it would be much faster. Therefore, an increase in terms is possible, I do not see anything terrible here. Obviously, there were good reasons for this, ”the specialist said.
