Disabled and needy parents have the right to file for child support for adult children. According to lawyer Alexander Redkin, in the overwhelming majority of cases, the court takes the side of the parents. This was confirmed by Victoria Dergunova, head of family law practice at BGP Litigation.

According to experts, the only ground that exempts from the obligation to support his parent is the improper performance of his parental duties.

“The evidence in this case will be administrative or criminal liability for non-payment of alimony,” Dergunova stressed.

As Redkin noted, some mothers, left alone with the child, prefer not to file for alimony, because in the future they hope that when the child reaches the age of majority, the father who left the family will also not file for alimony in his favor. But this practice is wrong.

“It doesn’t matter whether the parent paid child support or not (if they were not assigned to him) - almost always the court will collect money from the child for maintenance,” the lawyer said.

At the same time, a guaranteed denial of child support is possible only if the plaintiff is deprived of parental rights, Redkin noted.
