State Duma Deputy, Deputy Chairman of the State Duma Committee on Information Policy, Information Technologies and Communications Anton Gorelkin commented on the decision of the Moscow Magistrates' Court to impose a turnover fine on Facebook.

“This is far from the biggest fine that Facebook has paid. He paid much more to European regulators and the US government for violations of this kind. Therefore, it cannot be said that this fine is something new for the company. The decision of the Moscow Magistrates' Court is fair, and the consequences for Facebook will be serious, ”he said.

The deputy also stressed that this fine will affect the observance of Russian legislation by foreign IT companies, since the sanctions for non-execution of a court decision are quite serious.

“Yes, on the one hand, Facebook, unlike Google, does not have a Russian legal entity. And in case of non-payment, the bailiffs will not be able to block his accounts. However, Facebook has repeatedly stated that it would like to be present in the Russian segment of the network in a civilized manner, make money and work according to an advertising model.

There are several effective measures in Russian legislation that effectively influence the economic interests of companies. For example, companies can be banned from advertising activities, which could reduce their revenues in the Russian segment to zero. The consequences of this will be much more serious than paying a fine, ”Gorelkin said.

In his opinion, such a decision should change the attitude towards Russian legislation to a more loyal one.

“At the moment, Facebook is trying to sit on two chairs - it reacts to the actions of the regulator, but very belatedly. I have long called for the introduction of turnover fines, which is a fairly effective measure to protect the rights and interests of Russian users. Undoubtedly, such measures will affect the level of compliance with Russian legislation, ”the parliamentarian concluded.

Recall that on December 24, the court imposed a turnover fine on Facebook in the amount of 1.9 billion rubles for systematic failure to remove prohibited content. According to Russian law, the punishment for such an offense for online platforms is from 1/20 to 1/10 of the company's annual turnover.
