Russia (bbabo.net) - In 2022, debtors on loans will have the opportunity to protect part of their funds from debt cancellation. From February 1, 2022, those who owe money to banks and cannot return it on time will be able to apply to bailiffs with a statement on the preservation of wages and other incomes every month in the amount of the subsistence minimum. This is stated in the Federal Law of June 29, 2021 N 234-FZ.

Honored Lawyer of Russia Ivan Soloviev explained to the Prime agency that a citizen needs to submit an application to the bailiff service with documents confirming the existence of a monthly income, and also indicate the source of this income. In the presence of such an application, the bank will not be able to foreclose on this amount protected by law. "In addition, if the debtor has dependents, he will be able to file a claim with the court on the preservation of wages and other incomes every month in an amount exceeding the subsistence minimum," the expert emphasized.

However, this innovation will not affect all categories of debtors. For example, those who are in debt on executive documents containing demands for the recovery of alimony will not be able to submit an application to the bailiff service; compensation for harm caused to health; compensation for harm in connection with the death of the breadwinner; compensation for damage caused by the crime.

While it is forbidden to write off more than 50 percent of wages or pensions. However, under such a scheme, for people with incomes at the level of the subsistence level, writing off half of the amount means that the person is actually left without money. For 2022, the government approved a living wage of 11,950 rubles, for the working-age population - 13,226 rubles, for children - 11,592 rubles, and for pensioners - 10,277 rubles.
