Russia - In 2022, the cost of notary services rose by an average of one percent

Russia (bbabo.net), - The Federal Notarial Chamber denied rumors about the increase in prices for notary services. On average, tariffs have risen in price by one percent. Moreover, in 28 regions the average cost of a notarial act has even decreased.

“Every year, for each subject of the Russian Federation, the maximum amount of payment for services of a legal and technical nature is set for each individual notarial act, whether it is a power of attorney in Samara, an inheritance in Izhevsk or a transaction in Khabarovsk,” the FNP said. “For 48 regions, the increase was from 0.1 percent to 8.9 percent, in 28 regions, on the contrary, the average cost of a notarial act decreased, in the rest it did not change.

Payment for services of a legal and technical nature, by virtue of the law, is an integral part of the total cost of almost all notarial acts. The second component is the tariffs specified in the Fundamentals of the legislation of the Russian Federation on notaries and in the Tax Code. “They were established at the beginning of the 2000s, and have never been revised, despite the fact that initially they did not correspond to the real cost of performing a notarial act,” the notary continues. “So, the tariff for certifying a will, according to the Tax Code, is 100 rubles, with an average cost of this notarial act in the country of 2,500 rubles.

Thus, payment for services of a legal and technical nature, by virtue of the law, has become a natural regulator of the real cost of a notarial act. Each year, for each subject, its maximum size is set. Within this value, the notarial chamber of the region establishes the effective amount, which may be lower than this limit. “At the same time, the established amount of payment is obligatory for all notaries of this region, who do not have the right to arbitrarily reduce or increase it,” the notary community emphasizes. the most important indicators. For example, the cost of living in a constituent entity of the Russian Federation, the number of notarial acts performed, and a number of other indicators and coefficients are taken into account. Social aspects are also taken into account - for example, over the past two years, the Federal Notarial Chamber announced a moratorium on increasing the amount of payment for legal and technical services for socially significant notarial acts.

“Moreover, often local notary chambers, taking into account local realities, can seriously reduce the current amount of payment compared to the established maximum amount,” the Federal Tax Service says. “So, for several years in Tomsk, the cost of a will certification was almost half as much as in neighboring Kemerovo (and the national average), and due to the moratorium announced by the FNP on changing rates for this notarial act, the adjustment became possible only this year.

The cost of certain notarial acts in certain regions this year underwent a point adjustment, which exceeds the average figures, but we note that the average increase in the cost of notary services was about 1%. This is well below the official figures for inflation and the rise in many tariffs and consumer prices."

It is important to emphasize that the notary conducts its activities on the principles of self-financing. Notaries have the right to receive income only by paying for the performed notarial acts, without receiving any budgetary funds. At the same time, notarial activity is not an entrepreneurship and does not pursue the goal of making a profit. Notaries act on behalf of the Russian Federation.

The entire large-scale electronic system of the "digital notary" in the country, including all the numerous public online registries and services, has been developed, created and developed solely at the expense of the notary - mandatory contributions that notaries are required to make to notary chambers and FNP.

From the same funds, notarial activities are financed in hard-to-reach and sparsely populated territories, where, for example, a notary can spend several days certifying one power of attorney in a remote camp, and it is impossible to maintain a notary's office on the principles of self-financing. Numerous benefits, worth more than two billion rubles a year, are also provided by notaries at their own expense, without reimbursement from the budget.
