The court fined Freelancer.com for refusing to store data of Russians in the Russian Federation after their localization

On August 16, a Moscow court fined Freelancer.com, an Australian Internet platform for working with freelancers, for refusing to store Russians' data on servers located in the Russian Federation. The companies issued a fine in the amount of 500 thousand ₽.

Freelancer.com was accused of violating Part 8 of Article 13.11 of the Code of Administrative Offenses of the Russian Federation (failure by the operator, when collecting personal data, of the obligation to store personal data of Russian citizens in the Russian Federation). The maximum fine under this article is 6 million rubles.

Representatives of Freelancer said in court that by mid-August 2022, the data of the Russians had already been placed in Russia. They asked the court to stop the proceedings due to the lack of evidence of the offense, or limit themselves to a warning, or impose a punishment below the minimum possible.

“I think that those companies that somehow try to stay on the Russian market should be encouraged,” the judge explained.

In June, a court fined Google 15 million rubles for repeatedly refusing to localize the personal data of Russians.

In the same month, streaming service Twitch and photo hosting Pinterest received fines of ₽2 million for a similar violation. For the same reason, the UPS cargo delivery service was fined 1 million rubles.

In July, the world court received an administrative protocol on the American hotel booking service Hotels.com, it faces a fine of up to 6 million ₽. The protocols were then sent to WhatsApp, Spotify, Snapchat and Zoom. Whatsapp was fined 18 million rubles for repeated refusal to localize data. Snapchat received a fine of 1 million rubles.

Apple also received the first fine under this article, it was ordered to pay 2 million rubles. A similar amount must be paid by Tinder.

Apple Inc and Ookla (owner of Speedtest, a service for measuring Internet speed) have already appealed decisions on millions of dollars in fines for refusing to localize data.
