Russia (bbabo.net), - The Plenum of the Supreme Court of Russia has begun drafting a resolution that will spell out in detail the rules for awarding compensation for non-pecuniary damage. Most importantly, the Supreme Court directs lower instances to increase the amount of compensation to ordinary people for grievances. It is these legal positions that will be promoted.

The news was announced during the Meeting of Judges of the Courts of General Jurisdiction and Arbitration Courts, which takes place online.

The leadership of the Supreme Court of Russia, speaking to all the judges of the country, especially emphasized that one should not take a formal approach when awarding compensation. Courts must provide full and clear justification for the amount charged. And if a decision is made to cut off the stated requirements, then it is necessary to explain the motives. Suppose a person demanded a million rubles from a neighbor for a dog bite, and the court appointed only ten thousand. Why? This should be reflected in the document.

"The concept of improving the judiciary, legal proceedings and the legal status of judges, being implemented in the Russian Federation, certainly contributes to the rule of law, the legal protection of citizens and businesses, and expanding access to justice," Chairman of the Russian Supreme Court Vyacheslav Lebedev emphasized during the meeting.

In turn, the chairman of the commission of the Association of Lawyers of Russia on determining the amount of compensation for moral damage, Irina Fast, said that the average amount of compensation for moral damage for 2019 was 85 thousand 68 rubles, for 2020 - 80 thousand 527 rubles, for the first half of 2021 - 49 thousand 404 rubles.

"In the law enforcement practice of courts of general jurisdiction, there is an acute problem of recovering low, and often meager compensation for moral damage," she says.

At the same time, the lawyer emphasizes: the Supreme Court of Russia is doing a lot to change the situation. According to her, over the past two years, the Supreme Court of the country has had more than 20 cancellations of decisions of lower instances precisely because of the insignificance of the assigned amounts. This is a lot and proves that systematic work has begun in this direction.
