WADA considers CAS decision on Valieva a rewrite of the anti-doping code

The World Anti-Doping Agency (WADA) said that the reasoning part of the Court of Arbitration for Sport (CAS) decision in the case of Russian figure skater Kamila Valieva confirms a violation of the organization's code. This is stated in a message published on the agency's website.

“The reasoning part of the decision confirms that a panel of the Court of Arbitration for Sport (CAS) decided to ignore the clear and unequivocal provisions of the World Anti-Doping Code regarding the criteria for lifting a mandatory provisional suspension. In fact, in making this decision, the CAS panel rewrote the code, stating that the mandatory provisional suspension for “protected persons” should now be treated as an optional provisional suspension.

WADA believes that such a “rewrite of the code, which would presumably allow ‘protected persons’ to continue to compete after testing positive for unspecified substances without any clarification of the circumstances, risks undermining the integrity of sporting events and athletes’ confidence that they compete on an equal footing."

Plushenko called figure skater Valieva "a very big athlete" Olympics 2022 The agency is convinced that the episode with Valieva is a dangerous precedent. The organization expressed the hope that CAS would not make such decisions in the future.

WADA stressed that the Russian Anti-Doping Agency (RUSADA) is responsible for the late doping check of the athlete. “With regard to the delay between sample collection and the reporting of a positive test result by the anti-doping laboratory in Stockholm, as announced on February 14, WADA reiterates that RUSADA is clearly responsible,” the report says.

The agency believes that RUSADA did not provide effective support for communication with the laboratory to ensure timely analysis of samples, especially on the eve of a major international sporting event. “Unfortunately, RUSADA did not mark the high priority of the sample, despite the fact that the laboratory reported delays caused by the coronavirus outbreak among its employees,” WADA added.

They also noted that if the RUSADA disciplinary committee decided not to lift the mandatory provisional suspension, this decision would not be subject to appeal at all in accordance with the WADA code.

Zhurova announced the unprecedented pressure on Valieva during the Olympics Olympiad 2022 Valieva at the end of December 2021 passed a positive doping test for trimetazidine. The test results became known after the end of the team figure skating competition at the Olympics, in which the Russian team with Valieva won.

RUSADA imposed a temporary suspension on the athlete, which was lifted by the agency's disciplinary committee the next day. The International Olympic Committee (IOC), the International Skating Union (ISU) and WADA filed appeals against the skater's admission to the Games, but the CAS exit panel took the side of RUSADA and allowed Valieva to compete in the individual tournament. After the short program in the individual competitions, the Russian woman took first place, but in the free program she made a series of mistakes and ended up without a medal. Gold was taken by her compatriot Anna Shcherbakova, silver was taken by another representative of Russia, Alexandra Trusova. In third place was the Japanese Kaori Sakamoto.
